  3. TO BE NEGOTIABLE INSTRUMENT, A DOCUMENT SHOULD CONTAIN AN ORDER OR A PROMISE TO PAY A DEFINITE SUM OF MONEY AND NO MORE.
  4. AN INSTRUMENT IS A NEGOTIABLE INSTRUMENT IF IT SATISFIES TWO CONDITIONS:-
  5. THAT IT IS IN THE FORM WHICH IS CAPABLE OF BEING USED BY THE HOLDER FOR THE TIME BEING IN HIS OWN NAME
  6. THAT IS TRANSFERABLE LIKE CASH BY DELIVERY

Ø  SEC 13(1) OF THE NEGOTIABLE INSTRUMENTS ACT,” A NEGOTIABLE INSTRUMENT MEANS A PROMISSORY NOTE, BILL OF EXCHANGE OR CHEQUE PAYABLE EITHER TO ORDER OR TO BEARER.
·         A NEGOTIABLE INSTRUMENT IS ONE WHICH WHEN TRANSFERRED BY
  1.  DELIVERY OR BY ENDORSEMENT AND
  2.  DELIVERY PASSES TO THE TRANSFEREE A GOOD TITLE TO PAYMENT
  3. IRRESPECTIVE OF THE TITLE OF THE TRANSFEROR PROVIDED THE TRANSFEREE IS A BONAFIDE HOLDER FOR VALUE WITHOUT NOTICE OF ANY DEFECT IN THE TITLE OF THE TRANSFEROR.

  8. PRESUMPTIONS:-CERTAIN PRESUMPTIONS LIKE CONSIDERATION HAS BEEN PAID,ORDER OF ENDORSEMENT
